Married Couple Filing SR22 In Chicago Illinois
Reader’s Question:
Can I file for an SR22 under my car insurance Company for my husband? He has recently been detained due to DUI and we need to get his license back (since he already served his time) for work here in Chicago. He has also had some previous violations here in Illinois but that was a long time ago, will all of this affect me as well?

Since you are the spouse, and if the car your husband was arrested in for DUI is under your car insurance coverage, you should be able to have your car insurance company there in Chicago, Illinois file an SR22 for you. The unfortunate thing, however, is since your husband got charged for DUI this will go against your record as well as written under state law. This could also mean an increase in the amount your paying for car insurance for a while until both of you are able to demonstrate financial responsibility through the said SR22 form and avoiding future infractions, even speeding tickets.
Do take note that you will normally only need to maintain your SR22 for about a couple of years but this still depends on the gravity of your husband’s offense. I suggest you talk to your insurance agent immediately about getting the SR22 since you will need to get your husband’s license back as quickly as possible. Make sure to also ask your insurance agent about the other necessary paperwork needed to be accomplished in this case. Finally, since you mentioned that he has had some bad driving records in the past, it will be up to you to make sure your spouse knows the implication of further being caught or pulled over for any other form of driving violation as the resulting penalties and fees will be significantly more severe with repeat offenders.
