Reader’s Question:

I live in Chicago, Illinois and I am curious if a car is in forfeiture with a state due to a DUI conviction will GAP insurance cover the loan amount?

Alexia

Chicago, IL

No, a forfeiture of your car to the state due to a DUI conviction will not normally be covered by your GAP insurance. GAP insurance pays the balance left on a loan after a car’s actual cash value (ACV) has been paid out by a primary insurance company after a covered loss; such as the car being totaled out in a car accident or being stolen and declared a total loss.

A forfeiture or seizure by your state’s law enforcement of your car would not count as a covered loss by either your primary insurance provider or your GAP insurance carrier. If your state’s laws allow your car to be seized by the state after a DUI conviction then this would not be a covered loss in which a car insurance provider in Chicago, IL would pay out actual cash value to your (or your lien holder) for the car and thus the difference (or gap) between ACV and your loan balance would not be there for GAP insurance to pay. But instead your whole loan balance would be due. Many states auction or sell off cars they obtained from seizures or forfeitures in which case your lien holder may get some money for your vehicle from the state. Likely this will not be enough to pay off what you owe and leaving you to pay off the remaining loan balance. If your car was forfeited to the state due to a DUI conviction, then you should contact the courts involved in your case to find out what they do with seized vehicles and if there will be money going to your lien holder from a sale. You then should also speak with your lien holder regarding this situation to see what balance you will have left and how to go about paying it off.

The offense will permanently stay on your driving history if you are convicted of DUI. If you are convicted and/or arrested, you may lose your drivers license and be fined and/or imprisoned. Repeat convictions or arrests may result in severe penalties.

Typically, an SR22 insurance is required to be carried for a period of 3 years. To know exactly how many years you are required to carry the SR-22 due to a DUI conviction in Naperville, Illinois you may contact the Illinois Secretary of State directly.
Pat

Bolingbrook, IL

If you are going to move out of Illinois, your 2 DUIs are likely to follow you. Most states are part of the Driver’s License Compact (DLC) that means member states share driver license information.

Your former DUIs in Bolingbrook, IL and current revocation of your license in Illinois should therefore be seen by whatever state you choose to move to. There might be some states that are willing to give you a restricted license or permit you to operate a vehicle with a permit if you have an interlock ignition system. To check of what states might permit this you should contact the Department of Motor Vehicles of the state(s) in which you are interesting in moving to.

I do not have a vehicle currently but I do have a driver’s license. Am I required in Illinois to buy insurance to drive my friend’s car on a some occasion? I live in Rockford, Illinois.

Joseph

Rockford, IL

The state of Illinois law (625 ILCS 5/7-601) states that it requires all car owners to have minimum amounts of car liability insurance. According to the IL Division of Insurance, lending institutions may require physical damage insurance to protect their interest in a financed car.

Generally, the car owner’s policy on a car that you may borrow on a some occasion should cover you as a motorist. For instance the Illinois DOI states that the typical bodily injury liability coverage pays for bodily injury to another individual or property damage you cause due to the negligent operation of a car. It may also pay if the accident was caused by a member of your household living with you or an individual using your car with your permission in Rockford, IL.

You may not be required to have your own insurance policy if you do not own a vehicle in Rockford, IL, nor have a vehicle in your household whose insurance policy you could be put on, then you can obtain a non-owners policy. Non-owners insurance typically is additional coverage to provide you liability protection for when you are at fault and do not own a car.

Jill

Rockford, IL

In Illinois, a DUI conviction does not come off of your driving record in the. A DUI stays on your driver’s abstract forever.

According to the Illinois Secretary of State (SOS) a traffic violations such as speeding, improper lane usage, disregarding a traffic control light, etc. stay on a driver’s record for 4 to 5 years from the date of conviction. If the ticket forms the basis for a revocation or suspension, the information will be carried on your driving record for a minimum of 7 years from the date of reinstatement.

In Illinois, drug/alcohol offenses stay on a driver’s record for a lifetime according to the SOS.

To verify how long your insurance provider can rate you for the DUI you can speak with your insurance agent to see how far they “look back” for period goes and check with the IL Division of Insurance to verify what state law says about this situation.

Danny

Chicago, IL

In Illinois, Financial Responsibility Insurance or SR-22 is the tool the state uses to monitor the insurance of problem motorists.

Driving under the influence (DUI) is a very serious offense that is classified in Illinois as a violent crime. The offense will permanently remain on your driving record If you are convicted of DUI. If you are arrested and/or convicted, you will be be fined and/or imprisoned or you may lose your driving privileges. Repeat offenders may face greater penalties.

To reinstate your license after a DUI, the Secretary of State (SOS) monitors insurance coverage, by means of the SR22, for a period of time specified by law. The Illinois SOS does not state exactly the amount of time each offense requires the SR-22 to be maintained but we have seen many times that Illinois requires it to be maintained for at least 36 months (3 years).

Lionel

Decatur, IL

You will need to get a valid United States driver’s license before you can get a quote for the Illinois auto insurance. In some cases, you will need to have a valid U.S. license in order to buy insurance, anyway. There are some auto insurance companies in Decatur Illinois who will quote you and sell auto insurance to you with your international driver’s license. But, they will require you to get your regular driver’s license within thirty to forty-five days of your policy’s inception date, or they will cancel your auto insurance policy.

If you get your valid United States driver’s license and you still need a quote for auto-insurance policy, you can get a quote and have the ability to purchase your policy immediately online.

I received a quote for auto insurance, Springfield Illinois for $210/yr. After a week I went in and signed the auto insurance policy. The next day I received a call from an auto insurance agent saying that the underwriters changed the snowmobile policy on the previous Monday, between the quote and signing. The new quote under the new policy came in at a bit higher than the first quote. Am I entitled to the first auto insurance quote price since it was performed before the change took place?

Allan

Springfield, IL

I would suggest that you should check with the Illinois insurance regulator, Office of the Commissioner of Insurance (OCI), to check what IL state insurance statutes have to say about your current situation.

Generally, when you are quoted an auto insurance rate Springfield Illinois, the auto insurance agent tells you how many days that specific rate is good for. If you came in within that time then you may have an issue with the insurance provider if they are stating it is their underwriting that changed rates and the rate change was not due to something they found out about you after issuing the auto insurance quote, such as your driving record was different then you stated in the application, etc.

The auto insurance agent in Springfield Illinois should be able to give you a satisfactory explanation for the increase in your premium. If you feel that your premium was intentionally quoted low in order to get your business, you should be able to file a formal complaint with the OCI.

Hi, I live in Naperville Illinois. My question is: Does getting rate quotes in IL affect your credit score since the auto insurance companies check your credit history?

Jonas

Naperville, IL

Most auto insurance companies in Naperville IL do check credit scores when determining insurance rates. It is true that credit rating companies like Experian, Trans Union and Equifax have been known to use inquiries towards your credit report to impact your credit score. These queries that affect your credit score are queries for getting credit NOT inquiries that review your credit (like an auto insurance quote) or use credit as a portion of your insurance score.

The exact formula for calculating credit scores are closely guarded as secrets. Usually, most recently developed credit scores recognize when a person is shopping for auto insurance and either ignore multiple inquiries or count them as only one inquiry if they occur within a specific period of time.
